1. INTRODUCTION
Acceptance of this document implies that the user has read, understands, and comprehends what is stated here; that they are a person with sufficient legal capacity to enter into a contract and that they assume all obligations set forth in this document.
The provider of the services contracted by the user is LavaZum - powered by OpenVend, with registered address at OpenVend, Tax ID (NIF/CIF): (). The provider reserves the right to unilaterally modify these General Terms and Conditions, without affecting services or promotions provided prior to the modification. It is the user's responsibility to periodically read the conditions of this website.
These terms shall apply to contracts made through the website https://openvend.lavazum.com/pwa?name=lavaZum, domain and subdomains owned by Tarroc Technologies S.L., a company with registered address at Av. Grazia Deledda 5-16, 28909 Getafe, Tax ID (CIF): B-86500006, which is responsible for operating the platforms used by as the service provider.
The user may optionally register on the website via an email address, for which they have full responsibility for use and custody, and are responsible for the accuracy of the personal data provided to the provider.
2. OBJECT OF THE CONTRACT
This contract aims to regulate the contractual relationship established between the provider and the user at the moment the latter accepts the terms and conditions during the online contracting process. The contractual relationship involves the delivery, in exchange for a specific price publicly displayed on the website, of a particular product or service.
3. CONTRACTING PROCEDURE
When accessing the services offered by the provider, the user will do so anonymously, although their originating IP address will be recorded, and their anonymous profile will be linked to the browser used on their mobile terminal or other device. The user may optionally create a user account, the details of which will be sent to the email inbox used to request the service. For this, the user must freely and voluntarily provide the required personal data. In doing so, the user agrees to diligently use the generated username and temporary PIN, not to disclose them to third parties, and to notify the provider of their loss or theft or any possible unauthorized access by a third party, so that the provider can proceed with immediate blocking. It is hereby informed that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure is as follows:
Booking request and payment directly on the webapp, optionally logging in via email and subscribing.
Selection of the machine (washing machine, dryer, box, vacuum cleaner, etc.).
When placing the order, the selected machine and the service price will be indicated. Additionally, the capacity in kilos for washing machines and dryers and/or the operating minutes for dryers or vacuum cleaners.
The customer pays in advance and is redirected to the bank's payment web pages, where they enter their banking details with a bank card or their phone number in the case of Bizum. Payment can be made with Visa, Mastercard, and Bizum cards. To minimize the risk of unauthorized access, the bank always uses secure payment and for recurring payments (One-Click payment) will encode their card data and provide a token securely. When paying, the user confirms that the credit card or phone number associated with Bizum is theirs. Credit cards and Bizum are subject to checks and authorizations by their issuing entity. If the issuing entity does not authorize the payment, under no circumstances shall be responsible for this, and the service contract will not be formalized.
Under no circumstances does the lavaZum.com solution, as the service provider platform, store credit cards or phone numbers used in the purchase process. This data is entered directly on the bank's pages securely, without visibility from lavaZum.com.
Once the machine is running, the duration of the wash cycle in washing machines and boxes displayed in the lavaZum.com application will be approximate. The machine, based on its programming and efficient use of chemicals and water, will adjust the actual cycle time, and therefore the time displayed on the machine will always prevail.
4. DEFECTIVE SERVICES
In case of defective services, the customer may request a new service by email by sending a message to . All claims must be formalized immediately by email, indicating exactly what happened and attaching photographic evidence of the occurrence.
The subscription has no minimum commitment period. The maximum period to process cancellation is 3 days before the end of the subscription month (which lasts 4 weeks, 28 days). Cancellation can be requested via our phone 123456789 or our email . A cancellation is not confirmed until the customer receives the corresponding cancellation email.
For registered users, the team will inform the user, once the contracting procedure is completed, via email regarding all characteristics, price, contracting date, selected machine, and its corresponding locations of the contracted service. An order is not final until it is confirmed by via the enabled email.
5. PRICES
The indicated prices include Value Added Tax (VAT) or other applicable taxes and will always be expressed in Euro currency (€). Furthermore, the prices include other additional and ancillary services related to the requested service. Applicable prices will be those published on the website and app, and automatically applied during the final phase of the contracting process.
For registered users, any payment made to the provider will be notified to the customer by email. If the customer wishes to have their invoice, they can request it by email in the name of the registered user (email) at , indicating the identifier(s) of the order(s). For any information about the services offered by , the user can contact .
6. POLICY ON CANCELLATION OF SERVICES, RETURNS, AND REFUNDS
This policy regulates the conditions applicable to laundry and drying services contracted through our app, without a prior booking system.
Service Cancellation
a) Washing
· Once a wash cycle is paid for and/or started, it cannot be canceled by the user. Interruption or cancellation of an ongoing wash can only be performed by our qualified personnel, and only in justified cases (technical incidents, activation errors, or other exceptional causes).
· To request a review of a started wash, the customer must contact Customer Service by phone.
b) Drying
· The drying cycle can be stopped at any time simply by opening the dryer door.
· Opening the door triggers the automatic stop of the service, which does not necessarily imply a refund of the paid amount.
Cancellation requests via the app, email, or other channels besides phone will not be accepted.
Returns
Due to the nature of the services provided:
· Returns are not admitted once washing or drying has started, except in cases of technical incidents or errors attributable to the system or machines.
· Any incident must be reported exclusively by phone to Customer Service for evaluation.
Refunds
Refunds, when applicable, will be managed only after contacting our Customer Service by phone.
· Each case will be analyzed individually by our staff.
· Upon approval, the refund will preferably be made through the same payment method used in the app.
· The crediting times will depend on the banking entity or the payment method provider.
7. CLAIMS, LIABILITY, AND COMPENSATION
In any case, the maximum period for claims is 48 working hours from the moment the service ends: washing, drying, etc.
Under no circumstances is responsible for misuse of the machines or incorrect washing/drying of a garment. To ensure correct use of the machines, the user must follow the washing label available on the garment. Checks will be carried out using a reliable internal method, analyzing the cycle chosen by the customer and comparing it with the washing instructions label available on the garment.
In such cases, the laundry will compensate the user for the value of the garment according to the invoice, deducting the following amounts as maximum wear values, referring to the invoice date.
Less than one year → 20% of invoice value
From one year and one day to two years → 40% of invoice value
From two years and one day to three years → 70% of invoice value
More than three years and up to five → 75% of invoice value
Once the compensation process has started, the customer has 10 working days to send to Self-service Laundry any documentation they deem appropriate and that facilitates the valuation process of their garments, in order to offer as compensation an amount as close as possible to the current value of the garment.
In the absence of an invoice, compensation will be equal to the amount of the valuation agreed between and the customer. The compensated garment will remain at the disposal of .
Once the amount to be compensated is determined, an acceptance document will be sent to the customer. The customer will have 15 days to accept or reject this amount, so that can proceed with the payment.
8. USE OF THE WEBSITE
The user agrees not to make any improper use of this website, such as the intentional introduction of viruses, Trojans, worms, or any harmful and detrimental program or software to the system, as well as attempts to gain unauthorized access to the server, equipment, devices, and databases of . Non-compliance with this stipulation may lead to the declaration of criminal offenses defined by the applicable legislation on the matter.
9. DATA PROTECTION
The data provided by the customer is protected in accordance with our privacy notice, published at this link: Privacy Policy
10. SENDING PROMOTIONS AND OFFERS
During the registration process, you agree to receive promotional emails from the site lavaZum.com and its subdomains. However, you may subsequently opt-out of receiving such promotional emails by clicking on the link at the bottom of any promotional email.
The above is in accordance with the Federal Consumer Protection Law, as well as the Agreement establishing the operating rules and functioning of the Public Consumer Registry.
11. USER COMMUNICATIONS
Any communication you send to the lavaZum.com website or its subdomains, including but not limited to questions, criticisms, comments, suggestions, will become our sole and exclusive property and will not be returned, unless required by court order. Also, when you submit comments or criticisms to the site, you grant us the right to use the name you submit, in connection with that review, comment, or any other content. Finally, please note that you must not use a false email address, i.e., pretend to be someone you are not.
Likewise, the data that subscribers send to the lavaZum.com website to register various accounts in order to benefit from new subscriber promotions will be our property and will not be returned unless required by court order. Such accounts will be canceled and deactivated immediately; any benefit or promotion that was attempted to be redeemed will be canceled, and the subscriber who attempted to obtain the benefit may have the license granted at the time of subscription revoked, proceeding to cancel any product order they may have placed, without any liability on our part.
12. APPLICABLE LAW AND JURISDICTION
These terms shall be governed by or interpreted in accordance with Spanish law in all that is not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Terms and Conditions, to the Courts and Tribunals of Madrid. In the event that the user resides outside Spain, the provider and the user expressly waive any other jurisdiction, submitting to the Courts and Tribunals of Madrid.
